Terms of Service

These Terms govern your use of Landalyst services, reports, website, and related communications. By placing an order or using our service, you agree to these Terms.

Our Service

Landalyst provides independent construction phase and cost intelligence reports for clients managing construction projects remotely.

We are not a construction company, contractor, project manager, supplier, architect, engineer, estate agent, or legal adviser. We do not perform construction work, supervise construction work, guarantee project outcomes, or take responsibility for contractor performance.

Our service is designed to help clients better understand the current visible phase of a construction project, likely next-stage requirements, market price ranges, and potential payment-risk indicators.

Independence

Landalyst acts on behalf of the client who orders the report.

We do not act on behalf of your contractor, supplier, developer, estate agent, or any other third party involved in your project. We do not accept hidden commissions or referral fees from contractors or suppliers in relation to your report.

Where necessary, we may work with independent field verifiers, Quantity Surveyors, consultants, or service providers to deliver the ordered service.

Reports

Landalyst reports are advisory only. They are based on:

• visible site evidence captured during the site visit;
• documents and information you provide;
• professional review by our team or appointed reviewers;
• market price information available at the time of the report.

Landalyst reports do not guarantee:

• construction quality or structural integrity;
• contractor honesty or performance;
• final project cost;
• project completion timeline;
• future material prices;
• the accuracy of information withheld or misrepresented by third parties.

Our reports should not be used as a substitute for professional engineering, architectural, legal, or financial advice. Where structural, legal, contractual, or safety issues are involved, you should seek advice from a suitably qualified professional.

Client Responsibilities

You are responsible for ensuring that the information you provide to Landalyst is accurate and complete.

You confirm that you have the right to upload or share any documents, drawings, BoQs, invoices, contractor messages, photos, site access details, or other project materials you provide to us.

You are responsible for ensuring that Landalyst or its appointed representatives have reasonable access to the site where a site visit is required.

Payments, Cancellations, and Refunds

Payment is required before Landalyst begins work on your order.

If you wish to cancel an order, you must contact us as soon as possible. Once a site visit, document review, Quantity Surveyor review, or report preparation has started, refunds may not be available.

If we are unable to complete the service due to reasons within our control, we may offer a refund, partial refund, or rescheduled service at our discretion.

If we are unable to access the site because of incorrect information, denied access, unsafe conditions, or lack of cooperation from the client or site contact, the order may be delayed, rescheduled, or treated as completed depending on the work already performed.

Intellectual Property

All Landalyst branding, website content, report templates, pricing methodology, database structure, report formats, risk frameworks, and internal systems are owned by Terraglance Limited and protected by copyright and other applicable laws.

You may not copy, modify, reverse-engineer, resell, or reuse Landalyst materials to create or support a competing service.

You retain ownership of documents and materials you upload. By uploading them, you grant Landalyst a limited licence to use them solely to deliver the ordered service, communicate with you, maintain business records, and comply with legal or regulatory obligations.

Use of Reports

You may use your Landalyst report for your own project decision-making. You may share it with your contractor, adviser, family member, lawyer, lender, or other person involved in your project.

You may not resell, publish, modify, or misrepresent a Landalyst report, or use it in a way that falsely suggests Landalyst has made statements or guarantees beyond what is written in the report.

Prohibited Conduct

You may not use our service to:

• submit false, misleading, or unlawful information;
• harass, threaten, defame, or unlawfully pressure any third party;
• impersonate another person;
• upload materials you do not have the right to share;
• reverse-engineer, copy, or misuse our systems, methodology, or report formats;
• resell or repackage our reports as your own service.

Limitation of Liability

To the maximum extent permitted by law, Landalyst’s total liability to you shall not exceed the amount you paid for the specific report in question.

We are not liable for indirect, consequential, special, or punitive losses, including loss of project funds, construction delays, contractor disputes, loss of profit, loss of opportunity, or decisions you make based on the report.

Nothing in these Terms limits liability where it cannot legally be limited.

Privacy

Our use of personal information and project information is explained in our Privacy Policy.

By using Landalyst, you agree that we may collect and use information necessary to deliver the service, including your contact details, site details, uploaded documents, project information, and communications.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a new “Last updated” date.

Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.
